Whether you are at the start or the end of a relationship, whether your case is about your children, your finances or your relationship we are here to help. You can trust us to fight to secure the best outcome for you and your children. We want to help you make a new life and a new future for your family.
HOW WE CAN HELP YOU
Children – when you separate making arrangements for your children is difficult and very emotional. We understand that a sensitive approach is needed and help you make arrangements that put your children and their safety first.
Divorce – whilst it is now easier to issue the divorce yourself, it is still easy to get it wrong. Our expertise will ensure that your divorce goes right the first time.
Financial Settlements – even if you think your finances are straight forward, whether you have low to moderate assets, own a business or have high value assets ,it is important that you get specialist legal advice upon your separation, to ensure that you understand your rights and what you are entitled to. Don’t just accept what your ex tells you to. The process of separation is complex and based upon your individual circumstances. What is right for one person may not be right for another. We understand that you and your family are unique.
Cohabitation Disputes – however long you have lived together for or whether you have children, you don’t have the same rights as if you were married. Legally there is no such thing as a common law husband or wife. Getting the right legal advice, whether you are just moving in together or are splitting up Is important to protect you and your family.
Pre and Post nuptial Agreements and Cohabitation Agreements – protecting your assets whilst you are still in a relationship can mean you make better decisions when emotions are not running high. Our expert lawyers can prepare carefully drafted pre and post nuptial agreements, or cohabitation agreements if you are not getting married, which can protect assets you already own, an inheritance or a business and ensure appropriate provision is made for you and your children if you do have to separate in the future.
Declaration of Trust – if you are buying a property together but putting in unequal amounts a declaration of trust can make sure that you get your share back if you separate or you can leave your share to who you wish under a will., particularly if combined with a pre/post-nuptial agreement or cohabitation agreement. It is important that you get legal advice if you are married or getting married as to the protection this deed will provide you with.
Change of Name Deed – there are various reasons why you might want to change yours or your child’s name. We can help to ensure this is done correctly with professional advice and a properly drafted deed.
Care and Social services involvement– if the Local Authority’s Social Services Department become involved with your children and family it is imperative you seek legal advice so we can liaise with social services on your behalf and attend Public Law Outline (PLO) meetings with you to ensure you fully understand the process. If you are in care proceedings or have been notified that you will be, you will be eligible for Legal Aid automatically and will not have to pay and legal fees. Care proceedings occur when social services make an application to the court asking a Judge to look at your child’s situation and make a decision as to whether the child or children require a legal order to keep them safe.
At Hawley and Rodgers we believe in offering you the best advice and service, whatever your needs.
